    Comparative Legal Analysis of Copyright Protection: International Standards and their Implementation in Ukrainian Legislation

    This paper examines the comparative legal regulation of copyright protection at the international and national levels. The study analyses the common features and significant differences in approaches to copyright protection across various jurisdictions, focusing on the role of international conventions such as the Berne Convention for the Protection of Literary and Artistic Works and the Geneva Convention for the Protection of Producers of Phonograms. Special attention is given to the implementation of international standards in Ukrainian national legislation, including the influence of the TRIPS Agreement and EU directives on the development of Ukrainian copyright law. The paper highlights the key principles of copyright protection — national treatment, automatic protection and independence of protection — and examines the challenges Ukraine faces in harmonising its legislation with international requirements, particularly in the digital environment. У цій статті розглядається порівняльно-правове регулювання захисту авторських прав на міжнародному та національному рівнях. У дослідженні аналізуються спільні риси та суттєві відмінності у підходах до захисту авторських прав у різних юрисдикціях, зосереджуючись на ролі міжнародних конвенцій, таких як Бернська конвенція про охорону літературних та художніх творів та Женевська конвенція про охорону виробників фонограм. Особлива увага приділяється впровадженню міжнародних стандартів у національне законодавство України, включаючи вплив Угоди ТРІПС та директив ЄС на розвиток українського законодавства про авторське право. У статті висвітлюються ключові принципи захисту авторських прав — національний режим, автоматичний захист та незалежність захисту — а також досліджуються виклики, з якими стикається Україна у гармонізації свого законодавства з міжнародними вимогами, зокрема в цифровому середовищі.

    Concept of Modern International Criminal Justice: Genesis, Evolution and Mission

    This article examines the development of international criminal justice from the earliest military tribunals to contemporary institutional mechanisms. The emergence of the concept of international criminal responsibility is analysed through the lens of the psychology of justice and the spirit of post-war military tribunals. The article investigates the influence of diverse legal traditions – Anglo-Saxon, American, and Soviet – on the formation of the modern paradigm of international criminal law. Particular attention is devoted to the transformation of the mission of international justice in the context of globalisation and the novel challenges of the twenty-first century. The psychological dimensions of judicial proceedings are examined, including the symbolic significance of justice for victims and society, as well as questions of collective guilt and individual responsibility. The activities of major international judicial bodies – from the Nuremberg and Tokyo Tribunals to the International Criminal Court – are analysed. The multidimensional mission of contemporary international criminal justice, encompassing punitive, preventive, restorative, historical-documentary, and reconciliatory functions, is emphasised. It is argued that modern international criminal justice represents a synthesis of diverse legal cultures and a response to the imperatives of cross-border prosecution of crimes against humanity. The article identifies current challenges and prospects for the development of international criminal justice in the context of the transformation of the world order. У цій статті розглядається розвиток міжнародного кримінального правосуддя від найперших військових трибуналів до сучасних інституційних механізмів. Виникнення концепції міжнародної кримінальної відповідальності аналізується крізь призму психології правосуддя та духу повоєнних військових трибуналів. У статті досліджується вплив різних правових традицій – англосаксонської, американської та радянської – на формування сучасної парадигми міжнародного кримінального права. Особлива увага приділяється трансформації місії міжнародного правосуддя в контексті глобалізації та нових викликів ХХІ століття. Розглядаються психологічні виміри судового провадження, включаючи символічне значення правосуддя для жертв та суспільства, а також питання колективної вини та індивідуальної відповідальності. Аналізується діяльність основних міжнародних судових органів – від Нюрнберзького та Токійського трибуналів до Міжнародного кримінального суду. Підкреслюється багатовимірна місія сучасного міжнародного кримінального правосуддя, що охоплює каральні, превентивні, відновлювальні, історико-документальні та примирювальні функції. Стверджується, що сучасне міжнародне кримінальне правосуддя являє собою синтез різних правових культур та відповідь на імперативи транскордонного переслідування злочинів проти людяності. У статті визначено сучасні виклики та перспективи розвитку міжнародного кримінального правосуддя в контексті трансформації світового порядку.
