    Comparative Legal Analysis of Copyright Protection: International Standards and their Implementation in Ukrainian Legislation

    This paper examines the comparative legal regulation of copyright protection at the international and national levels. The study analyses the common features and significant differences in approaches to copyright protection across various jurisdictions, focusing on the role of international conventions such as the Berne Convention for the Protection of Literary and Artistic Works and the Geneva Convention for the Protection of Producers of Phonograms. Special attention is given to the implementation of international standards in Ukrainian national legislation, including the influence of the TRIPS Agreement and EU directives on the development of Ukrainian copyright law. The paper highlights the key principles of copyright protection — national treatment, automatic protection and independence of protection — and examines the challenges Ukraine faces in harmonising its legislation with international requirements, particularly in the digital environment. У цій статті розглядається порівняльно-правове регулювання захисту авторських прав на міжнародному та національному рівнях. У дослідженні аналізуються спільні риси та суттєві відмінності у підходах до захисту авторських прав у різних юрисдикціях, зосереджуючись на ролі міжнародних конвенцій, таких як Бернська конвенція про охорону літературних та художніх творів та Женевська конвенція про охорону виробників фонограм. Особлива увага приділяється впровадженню міжнародних стандартів у національне законодавство України, включаючи вплив Угоди ТРІПС та директив ЄС на розвиток українського законодавства про авторське право. У статті висвітлюються ключові принципи захисту авторських прав — національний режим, автоматичний захист та незалежність захисту — а також досліджуються виклики, з якими стикається Україна у гармонізації свого законодавства з міжнародними вимогами, зокрема в цифровому середовищі.

    Concept of Modern International Criminal Justice: Genesis, Evolution and Mission

    This article examines the development of international criminal justice from the earliest military tribunals to contemporary institutional mechanisms. The emergence of the concept of international criminal responsibility is analysed through the lens of the psychology of justice and the spirit of post-war military tribunals. The article investigates the influence of diverse legal traditions – Anglo-Saxon, American, and Soviet – on the formation of the modern paradigm of international criminal law. Particular attention is devoted to the transformation of the mission of international justice in the context of globalisation and the novel challenges of the twenty-first century. The psychological dimensions of judicial proceedings are examined, including the symbolic significance of justice for victims and society, as well as questions of collective guilt and individual responsibility. The activities of major international judicial bodies – from the Nuremberg and Tokyo Tribunals to the International Criminal Court – are analysed. The multidimensional mission of contemporary international criminal justice, encompassing punitive, preventive, restorative, historical-documentary, and reconciliatory functions, is emphasised. It is argued that modern international criminal justice represents a synthesis of diverse legal cultures and a response to the imperatives of cross-border prosecution of crimes against humanity. The article identifies current challenges and prospects for the development of international criminal justice in the context of the transformation of the world order. У цій статті розглядається розвиток міжнародного кримінального правосуддя від найперших військових трибуналів до сучасних інституційних механізмів. Виникнення концепції міжнародної кримінальної відповідальності аналізується крізь призму психології правосуддя та духу повоєнних військових трибуналів. У статті досліджується вплив різних правових традицій – англосаксонської, американської та радянської – на формування сучасної парадигми міжнародного кримінального права. Особлива увага приділяється трансформації місії міжнародного правосуддя в контексті глобалізації та нових викликів ХХІ століття. Розглядаються психологічні виміри судового провадження, включаючи символічне значення правосуддя для жертв та суспільства, а також питання колективної вини та індивідуальної відповідальності. Аналізується діяльність основних міжнародних судових органів – від Нюрнберзького та Токійського трибуналів до Міжнародного кримінального суду. Підкреслюється багатовимірна місія сучасного міжнародного кримінального правосуддя, що охоплює каральні, превентивні, відновлювальні, історико-документальні та примирювальні функції. Стверджується, що сучасне міжнародне кримінальне правосуддя являє собою синтез різних правових культур та відповідь на імперативи транскордонного переслідування злочинів проти людяності. У статті визначено сучасні виклики та перспективи розвитку міжнародного кримінального правосуддя в контексті трансформації світового порядку.

    Digitalization of Educational Process at Modern Universities: Evaluation of Positive and Negative Impact

    This article examines the transformative impact of digital technologies on higher education as of 2026. It explores how the integration of Artificial Intelligence (AI), Extended Reality (XR), and blockchain-verified credentials has shifted universities from experimental tool adoption to the creation of sustainable, data-driven learning ecosystems. The research identifies core trends, such as personalized adaptive learning and algorithmic career pathways, while addressing persistent challenges like digital inequity and the demand for ethical AI governance. This article examines the multidimensional nature of digital transformation within the Ukrainian higher education system as of 2026. It explores how digitalization, accelerated by the COVID-19 pandemic and subsequent military aggression, has become the primary mechanism for maintaining educational continuity. The study identifies key positive impacts, such as increased accessibility, personalization, and administrative efficiency, alongside critical negative factors including psychological burnout, technical barriers, and a decline in direct interpersonal communication. By synthesizing data from the "Concept of Digital Transformation of Education and Science up to 2026," the research provides a balanced view of the current state and prospects for university-level education in Ukraine. У цій статті розглядається трансформаційний вплив цифрових технологій на вищу освіту станом на 2026 рік. У ній досліджується, як інтеграція штучного інтелекту (ШІ), розширеної реальності (XR) та перевірених блокчейном сертифікатів змістила університети від експериментального впровадження інструментів до створення стійких екосистем навчання, заснованих на даних. Дослідження визначає основні тенденції, такі як персоналізоване адаптивне навчання та алгоритмічні кар'єрні шляхи, одночасно вирішуючи такі постійні проблеми, як цифрова нерівність та попит на етичне управління ШІ. У цій статті розглядається багатовимірний характер цифрової трансформації в системі вищої освіти України станом на 2026 рік. У ній досліджується, як цифровізація, прискорена пандемією COVID-19 та подальшою військовою агресією, стала основним механізмом підтримки безперервності освіти. У дослідженні визначено ключові позитивні впливи, такі як підвищена доступність, персоналізація та адміністративна ефективність, поряд з критичними негативними факторами, включаючи психологічне вигорання, технічні бар'єри та зниження прямого міжособистісного спілкування. Синтезуючи дані з «Концепції цифрової трансформації освіти та науки до 2026 року», дослідження забезпечує збалансоване уявлення про поточний стан та перспективи університетської освіти в Україні.

    Improvement Strategies of Research Academic Skills for Writing Scientific Theme Projects by University Learners: Based on the Case Study for the Business-Related Specialties Titled as “Challenges and Opportunities in the Application of Artificial Intelligence for Effective Business Management within the Economy”

    The process of learning in research constitutes a fundamental element of academic advancement, significantly contributing to the success of researchers. The fields of science and technology are evolving at an extraordinary pace, with new discoveries and inno-vations emerging daily. Consequently, it is essential for research-ers to perpetually refine their research capabilities and maintain a competitive edge. Lifelong learning, defined as the continuous quest for knowledge throughout one’s professional journey, is cru-cial for flourishing in one’s discipline. This article examines the sig-nificance of learning in research and delineates the advantages of developing research skills through customized courses designed for researchers.The purpose of the article is to demonstrate the formation of university learners research skills within the scientific theme project titled as “Challenges and Opportunities in the Appli-cation of Artificial Intelligence for Effective Business Management within the Economy”. The main research outcomes have demon-strated that to accomplish the scientific theme projects successful-ly we have identified the following structure and content material of research findings on the real case within the scientific theme project titled as “Challenges and Opportunities in the Application of Artificial Intelligence for Effective Business Management within the Economy” that includes such components as: abstract, introduc-tion, methodology of the research, three sections, six subsections, each section conclusions, general conclusions of the scientific theme project.Importantly, the case concerning the theme “Chal-lenges and Opportunities in the Application of Artificial Intelligence for Effective Business Management within the Economy” has high-lighted the significant advantages derived from academic research activities for university students during their higher education preparation. The domains of academic research accomplishments include the following: research allows graduate students to inves-tigate specific subjects in detail, thus improving their comprehen-sion of their respective disciplines; fostering critical thinking and problem-solving capabilities; contributing to the body of knowledge and society; building professional networks; enhancing career op-portunities; gaining practical experience; promoting independence and initiative; facilitating personal growth; improving communica-tion skills; and shaping future research trajectories. Навчання проводити наукові дослідження є фундамен-тальним елементом академічного прогресу, що значною мі-рою сприяє успіху дослідників. Галузі науки і техніки розвива-ються надзвичайними темпами, щодня з’являються нові від-криття та інновації. Отже, студентам університетів важ-ливо постійно вдосконалювати свої дослідницькі здібності та підтримувати конкурентну перевагу. Навчання протя-гом усього життя, яке визначається як постійне прагнення до знань протягом професійного шляху, має вирішальне зна-чення для процвітання у своїй сфері діяльності. У цій статті розглянуто значення навчання в дослідженнях та окресле-но переваги розвитку дослідницьких навичок за допомогою індивідуальних курсів, розроблених для дослідників. Метою статті є демонстрація формування дослідницьких навичок у студентів університетів у рамках наукового тематичного проєкту “Виклики та можливості застосування штучного інтелекту для ефективного управління бізнесом в економі-ці”. Для успішного виконання наукових тематичних проєктів ми визначили структуру та зміст дослідницьких результа-тів на реальному прикладі в рамках наукового тематичного проекту “Виклики та можливості застосування штучного інтелекту для ефективного управління бізнесом в економі-ці”, що має такі компоненти, як: анотація, вступ, методоло-гія дослідження, три розділи, шість підрозділів, висновки до кожного розділу, загальні висновки наукового тематичного проєкту. Важливо, що кейс щодо теми “Виклики та можли-вості застосування штучного інтелекту для ефективного управління бізнесом в економіці” підкреслив значні переваги, отримані від академічної дослідницької діяльності, для сту-дентів університетів під час здобуття ними вищої освіти. Важливою перевагою пропонованої роботи є академічні до-слідницькі досягнення студентів університету, зокрема такі: поліпшення розуміння дисципліни, із якої студенти ви-конують дослідження, унаслідок докладного вивчення певної проблеми; розвиток критичного мислення та здібностей до розв’язання проблем; внесок в обсяг знань та розвиток су-спільства; побудова професійних мереж; розширення кар’єр-них можливостей; отримання практичного досвіду; сприяння самостійності та ініціативності; сприяння особистісному зростанню; поліпшення комунікативних навичок, а також формування майбутніх дослідницьких траєкторій.

    Scientific-Research Work in Effective English Language Teaching Methods as an Integral Part of Professional Activity for University Tutor for English Courses

    his article explores the symbiotic relationship between scientific-research activity and pedagogical proficiency among university English language tutors. The author argues that research is not merely an administra-tive requirement but a foundational component of modern academic labor that informs classroom practice, enhances student outcomes, and facilitates professional growth. By bridging the gap between theoretical linguistics and practical methodology, tutors can integrate innovative technologies and evidence-based strategies to ensure high-quality educational results. Drawing on the concept of "Action Research," the study posits that educators who systematically investigate their own practices exhibit higher levels of adaptabi-lity and job satisfaction. Research serves as the engine for adopting cutting-edge frameworks such as Content and Language Integrated Learning (CLIL), Flipped Classrooms, and Task-Based Language Teaching (TBLT). Professional Competencies: Engagement in research fosters lifelong learning, cognitive development regarding sociolinguistic shifts (e.g., English as a Lingua Franca), and analytical skills for diagnosing learning gaps. Institutional Impact: Beyond the classroom, research contributions through publications and conferences elevate institutional rankings and ensure curriculum rigor. The article catego-rizes 25 priority areas for research, emphasizing: AI & digital innovation; cognition & instruction; socio-cultural pedagogy; specific purposes; critical skills for the researcher-tutor. The author outlines essential competencies required to bridge the research-teaching gap: traditional skills; pedagogical-specific skills; modern adaptive skills in particular ICT literacy for evaluating AI tools and collaborative networking across intercultural perspectives. The study concludes that scientific-research work moves the teaching profession from "intuition-based" to "evidence-based," reducing pedagogical burnout by transforming repetitive tasks into ongoing scientific inquiry. Future exploration is recommen-ded regarding institutional support systems and the use of AI tools for "Micro-Research" within the classroom. У статті представлено результати дослідження симбіотичного зв'язку між науково-дослідною діяльністю та педагогічною майстерністю викладачів англійської мови у закладах вищої освіти. Обґрунтовано, що наукова робота є не лише адміністративною вимогою, а основоположним компонентом сучасної академічної праці, який безпосередньо впливає на навчальний процес, покращує результати студентів та сприяє професійному зростанню.Долаючи розрив між теоретичною лінгвістикою та практичною методологією, викладачі можуть інтегрувати інноваційні технології та стратегії, засновані на доказах, для забезпечення високої якості освіти. Спираючись на концепцію «Action Research» (дослідження дією), у дослідженні стверджується, що педагоги, які систематично вивчають власну практику, демонструють вищий рівень адаптивності та задоволеності роботою.Дослідницька діяльність виступає рушійною силою для впровадження передових моделей навчання, таких як: CLIL (предметно-мовне інтегроване навчання); Flipped Classroom («перевернутий клас»); TBLT (завдання-орієнтоване навчання).Розкриваються ключові аспекти дослідження:Професійні компетентності: Участь у дослідженнях сприяє безперервному навчанню (lifelong learning), когнітивному розвитку в контексті соціолінгвістичних змін (наприклад, англійська як мова міжнародного спілкування —ELF) та формуванню аналітичних навичок для діагностики прогалин у знаннях.Інституційний вплив: Публікації та участь у конференціях підвищують рейтинги університетів та забезпечують ґрунтовність навчальних програм.Пріоритетні напрями: Автор виокремлює 25 напрямів досліджень, акцентуючи увагу на ШІ та цифрових інноваціях, когнітивістиці, соціокультурній педагогіці та спеціальних цілях навчання (ESP).Окреслено необхідні компетенції для подолання розриву між теорією та практикою: від традиційних і суто педагогічних до сучасних адаптивних навичок, зокрема цифрової грамотності для оцінки інструментів ШІ та мережевої взаємодії в міжкультурному середовищі.У висновках зазначається, що науково-дослідна робота переводить професію викладача з рівня «інтуїтивного» на рівень «доказового» навчання, запобігаючи професійному вигоранню шляхом трансформації рутинних завдань у постійний науковий пошук. Перспектива подальших досліджень вбачається у вивчення систем інституційної підтримки та використання інструментів ШІ для проведення «мікродосліджень» безпосередньо в аудиторії

    Sources of International Private Law: Concept and General Characteristics

    Internal reforms in the country, European integration processes, and the expansion of Ukraine's ties with foreign states (in trade, scientific-technical, or cultural spheres) contribute to the search for new approaches to international cooperation, which in turn heightens attention to the development of international law as a whole. It is well known that the legal regulation of any branch of law or legal relations is impossible without the operation of the institution of sources of law. Despite numerous studies on sources of law and their types, certain issues remain underexplored– particularly the specific features of sources of private international law and their place in the hierarchy of forms of expression of legal norms. In the modern world, situations increasingly arise where citizens of one state enter into legal relations with citizens of another– for example, by concluding contracts or marriages, inheriting property abroad, or opening businesses in another country. In all such cases, there is a need to determine which court has jurisdiction to hear the dispute, as well as how foreign judgments should be recognized and enforced. Sources of private international law play a key role in establishing the legal framework that ensures stability and fairness in resolving disputes. The absence of clear regulation or gaps in these sources can lead to legal uncertainty in the application of law. Внутрішні реформи в країні, процеси європейської інтеграції та розширення зв'язків України з іноземними державами (у торговельній, науково-технічній чи культурній сферах) сприяють пошуку нових підходів до міжнародного співробітництва, що, своєю чергою, посилює увагу до розвитку міжнародного права в цілому. Загальновідомо, що правове регулювання будь-якої галузі права чи правовідносин неможливе без функціонування інституту джерел права. Незважаючи на численні дослідження джерел права та їх видів, деякі питання залишаються недостатньо дослідженими, зокрема, специфічні особливості джерел міжнародного приватного права та їхнє місце в ієрархії форм вираження правових норм. У сучасному світі все частіше виникають ситуації, коли громадяни однієї держави вступають у правовідносини з громадянами іншої, наприклад, шляхом укладання договорів чи шлюбів, успадкування майна за кордоном або відкриття бізнесу в іншій країні. У всіх таких випадках виникає необхідність визначити, який суд має юрисдикцію для розгляду спору, а також як мають визнаватися та виконуватися іноземні судові рішення. Джерела міжнародного приватного права відіграють ключову роль у створенні правової бази, яка забезпечує стабільність та справедливість у вирішенні спорів. Відсутність чіткого регулювання або прогалини в цих джерелах можуть призвести до правової невизначеності у застосуванні права.
