    International Legal Aspects of Artificial Intelligence in Judicial Systems

    This article examines the international legal aspects of implementing artificial intelligence (AI) in judicial systems, emphasizing foundational principles such as accountability, ethics, judicial independence, data protection, and human rights. By analyzing Ukrainian judicial practice – including reflections of the Supreme Court and the strategy of the State Judicial Administration – as well as European standards, such as CCJE Opinion No. 26 (2023) of the Consultative Council of European Judges, the study identifies key legal risks associated with integrating AI into the judiciary. Based on these sources, a set of measures is proposed for the effective regulation of AI in this field. At the same time, the study stresses that AI is intended to assist judges without replacing the human element in decision-making. Considering the specific nature of judicial proceedings, robust legal safeguards are necessary to preserve public trust, fairness, and the rule of law. У цій статті розглядаються міжнародно-правові аспекти впровадження штучного інтелекту (ШІ) у судових системах, з акцентом на таких основоположних принципах, як підзвітність, етика, незалежність судової влади, захист даних та права людини. Аналізуючи українську судову практику, включаючи думки Верховного Суду та стратегію Державної судової адміністрації, а також європейські стандарти, такі як Висновок КРЄС № 26 (2023) Консультативної ради європейських суддів, дослідження визначає ключові правові ризики, пов'язані з інтеграцією ШІ в судову систему. На основі цих джерел пропонується комплекс заходів для ефективного регулювання ШІ в цій сфері. Водночас у дослідженні наголошується, що ШІ покликаний допомагати суддям, не замінюючи людський фактор у прийнятті рішень. Враховуючи специфічний характер судових проваджень, необхідні надійні правові гарантії для збереження суспільної довіри, справедливості та верховенства права.
